Article 6 - Price - Terms of Payment

Delivery costs are indicated to the Customer on the Platform at the time of choosing the delivery method and according to the product concerned. Delivery charges are invoiced in addition to the sale price. Delivery is free of charge for all orders over 150 Euros or when delivered to a Partner retailer. If a delivery is made in several partial deliveries, delivery charges will only be invoiced once.
The total price indicated on the final payment screen includes taxes and shipping costs. This price will be recorded in the order confirmation, which Mavic recommends the Customer print or download for future reference.
To ensure a secure and convenient purchasing process, Mavic offers the following payment methods via the services of payment provider ADYEN:

Mavic does not accept any payment methods other than those listed above. Please do not attempt to pay by any means other than those specified here. If you do, Mavic will not be responsible for the loss of payment or any other damage that may result from this action.
Article 7 - Shipping - Delivery
Shipping:
Mavic ships from France only to the following destinations:
- French territory (including Corsica). DOM-TOM are therefore excluded.
- Germany
Mavic delivers exclusively to the address indicated by the Customer.
Depending on the delivery method chosen by the Customer, once the product has been handed over to the transport company, the Customer will receive a shipment confirmation by e-mail, together with all the necessary information on the status of the shipment and, where applicable, a link to the transport service provider's tracking system.
Delivery :
Mavic offers several types of delivery provided by any type of carrier chosen by Mavic, namely:
- Home delivery
- Relay point delivery
- Click & service:
If the order contains at least one wheel, the Customer has the option of choosing a Partner retailer located in mainland France as the delivery address, by selecting the “Click & Service” option at the Mavic Partner during the order process.
The entire order must be delivered to the address of the selected Mavic Partner dealer, who will offer to mount the wheel(s) on the Customer's bicycle, subject to compatibility. The Customer must have taken care to check the compatibility of the wheel or wheelset purchased with the bicycle for which he wishes to benefit from the assembly. If this is not the case, the partner dealer may refuse to fit the wheels. In all cases, the Customer will recover the products from his order, and may return them separately by following the procedure described in the GCS.
The Customer will be notified by e-mail once his order has been received by the Partner Dealer, and will arrange a meeting with the Partner Dealer to collect his order and possibly have the wheel(s) installed on his bike. The assembly costs included only concern the regular assembly of the wheels, and any other service will be invoiced by the Partner Reseller in agreement with the Customer.
Collection is possible during the opening hours of the relevant Partner retailer to whom the delivery was made and upon presentation of official identification and notification of collection (e.g. in the form of an e-mail on the smartphone). The customer must check the opening hours of the partner retailer before collecting the order. The collection period is 14 days from the date of the product collection notice sent to the Customer.
The risks of loss or damage to the products are transferred to the Customer when he or a third party designated by him takes physical possession of the product.
Upon taking possession of the product, the Customer must notify Mavic and, where applicable, the carrier, of any reservations regarding the product delivered, in particular in the event of a defect in the product or failure to provide the instruction manual or installation instructions.
Delivery times are given for information only. They may vary due to various factors such as [availability of our carrier / order processing, force majeure, etc.].
Orders will be delivered according to the delivery method chosen and the opening or working hours of the delivery service provider. The Customer may refer to the “Deliveries and Returns” section of the Platform for further information.
As far as possible, Mavic tries to deliver all products ordered at the same time. However, the volume of orders may require separate deliveries.
Mavic reserves the right to split the delivery of the order, for example if part of the order is delayed or unavailable but the delivery address will still be the same. Mavic will inform the Customer of its intention to split a delivery by sending an e-mail to the e-mail address provided by the Customer at the time the order was placed. The Customer will not be charged for any additional delivery costs.
Upon delivery, the Customer or, failing this, the recipient, must inspect the packaging to check that it is in good condition. If there is any damage to the packaging, this must be mentioned on the delivery note, and the carrier must be asked to open the package in his presence to ensure that no product is missing or has been damaged. Should this prove to be the case, the customer must refuse delivery, stating the reason on the delivery note.
Article 8 - Returns - Cancellations - Refunds
If the Customer wishes to cancel his order before it is dispatched, he must contact Mavic customer service (see the “Contact Us” section). Customer service agents will check the status of the order and request its cancellation if possible. If successful, the customer will receive an e-mail and the cancellation will be free of charge. If cancellation is not possible, the product will be delivered and may be returned in accordance with the procedure described below.
The customer has the right to return products delivered to him/her if they are defective or do not conform to the order. If the claim is justified, the purchase price and shipping costs will be refunded. For practical information on returns, please consult the “Deliveries and returns” section of the Platform.
If, for any reason whatsoever, the Customer is not satisfied with a product ordered, he may exercise his right of withdrawal. The Customer may invoke his right of withdrawal by informing Mavic of his wish to return the product within 30 calendar days of delivery of the product to the Customer or to a third party designated by him (other than the carrier) or, if the Customer has ordered several products in a single order which is delivered separately, within 30 calendar days of delivery of the last product, without any reason.
If the Customer makes use of his/her right of withdrawal, he/she is obliged to return the products as soon as possible and at the latest within 30 calendar days from the date on which he/she communicated his/her wish to withdraw to Mavic.
If the Customer does not comply with the above, the return will not be accepted and no refund will be made.
The following return conditions must also be met:
- All products must have been purchased on the Platform. All items purchased elsewhere than on the Platform must be returned to their original place of purchase.
- Any product made to your specifications or clearly personalized cannot be returned.
- All products must be returned in their original, unaltered packaging, with all accessories, kits and instructions received with the order, accompanied by their return slip.
- Items must not have been worn and original labels must not have been removed.
- Wheels must not have been mounted or used, and must be returned with their kits and accessories.
Refunds will be processed within 5 to 7 working days of receipt of the item at our warehouse and verification by our quality department. Refunds are issued in the same way as the original payment.
For practical information on returns, please consult the help section of the Platform to contact customer service.
Article 9 - Force majeure
Cases of force majeure constitute, in application of article 1218 of the French Civil Code, “an event beyond the control of the debtor, which could not reasonably have been foreseen when the contract was concluded and the effects of which cannot be avoided by appropriate measures”, and in particular but not exclusively, strikes, collective disputes or any other collective action taken by third parties, civil unrest, riots, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or any other natural disaster or failure of public or private telecommunications networks, transportation difficulties and any other external cause impeding the dispatch of an order.
If Mavic is forced to cancel an order or a delivery due to force majeure, the sums paid up to the amount of the expenses already incurred for the order may be retained. The balance will be returned to the customer, but no compensation will be due by way of damages.
If any of the above events related to force majeure occurs and affects the performance of our obligations under these general terms and conditions of sale:
a) The Customer will be contacted as soon as possible to be informed; and
b) Mavic's obligations under these terms and conditions will be suspended and the time for performance of its obligations will be extended for the duration of the force majeure event.
If the force majeure event affects the delivery of a product, a new delivery date will be established with the Customer after the end of the force majeure event. The Customer may cancel the order if a force majeure event occurs, and Mavic no longer wishes the products to be delivered. Please refer to article 8 of the General Terms and Conditions for your cancellation rights.
Article 10 - Amicable settlement of disputes
In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Mavic adheres to a Mediation Service.

The Customer may only transfer its rights or obligations under these Terms of Sale to another person with Mavic's written consent.
Each paragraph of these Terms of Sale operates separately. If a court or competent authority decides that any of them is illegal or unenforceable, the remaining paragraphs shall remain in full force and effect.
Any failure by Mavic to invite the Customer to fulfil its obligations under these Terms of Sale, or to assert its rights against the Customer, or to assert them late, shall not be construed as a waiver of its rights.
Any waiver by Mavic of a defect on the part of the Customer must be in writing and shall not constitute an automatic waiver of any subsequent default on the part of the Customer.
Article 12 - Warranty and right to return the product (hidden defect or fault)
Consumers may benefit from three different MAVIC warranties: the legal warranty of conformity, the legal warranty for hidden defects and the commercial warranty. The legal warranties apply in all cases in compliance with the conditions governing them. The Customer must first contact Mavic's customer service department to find out how to implement the warranty. Mavic may ask the Customer to return the product concerned in order to determine whether it falls within the scope of the warranty.
In accordance with the provisions of the Decree of December 18, 2014, Order 2021-1247 of June 29, 2022 and Decree no. 2022-946 of June 29, 2022, the seller is liable for defects in conformity of the goods with the contract under the conditions of Articles L. 217-3 et seq. of the French Consumer Code and for hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. of the French Civil Code.
Mavic may grant certain of its products an additional commercial warranty from the end of the legal warranty period. The conditions of the commercial warranty are specified on the detailed product sheet.
